Constitution Day 2023
A short greeting, kept short as always, in a year when the legal framework was being rewritten at speed for a different reason.
A good Constitution Day.
Short as always. The constitutional arguments are not mine to enter.
What I will note is adjacent and, I hope, uncontentious. This was a period of exceptionally rapid legislation — European approximation, the candidate status conditions, wartime administration, reconstruction frameworks. A great deal of law was written quickly.
Writing law quickly is dangerous and sometimes unavoidable. What determines whether it goes badly is not the speed but whether the drafting is done in public, scrutinised, and open to correction when a defect appears. Most of this legislation was, and the defects that surfaced were largely corrected.
