Constitution Day, 28 June 2022

A short note on the anniversary in a year when the document was being defended rather than debated.

Ukraine marks the anniversary of its constitution today.

In most years I write that constitutional argument is not a foreigner's business, and it is not. This year there is barely an argument to stay out of.

What I will note instead is administrative and, I think, remarkable. Through these months the institutions that document establishes have continued to function: parliament has sat and legislated, courts have heard cases, the registries have recorded transactions, and officials have gone to offices.

A constitution is a description of how a state is supposed to work. This year the description and the reality stayed in the same place, under conditions that would have separated them in most countries.

A good Constitution Day to everyone marking it.
